Terms of Use & Purchase

1. About The Big Dog

The Big Dog is an entertainment and novelty digital title service. Users can pay the current Takeover Price to become the current holder of “The Big Dog” title.

The service is intended as a fun, status-based online experience — an internet flex. It is not an investment, financial product, gambling product, prize competition, ownership interest or opportunity to make money.

2. What you are buying

When a successful eligible payment is confirmed, the purchaser becomes the current holder of The Big Dog title. This gives the purchaser the temporary right, subject to these Terms, to:

  • be identified on the website as the current Big Dog;
  • have their eligible public profile displayed;
  • have their selected public social-media identity displayed and linked;
  • appear in relevant Big Dog history, rankings and Hall of Fame features.

The purchaser is not buying:

  • any physical property;
  • ownership of the website;
  • ownership of the thebig.dog domain;
  • shares or equity;
  • intellectual property rights in The Big Dog brand;
  • cryptocurrency or another financial asset;
  • an investment;
  • a transferable monetary balance;
  • a right to receive money from future purchasers.

The title itself has no guaranteed monetary or resale value.

3. How the takeover works

The initial Takeover Price is US$1. Following each successful takeover, the next Takeover Price ordinarily increases by US$1 — for example $1 → $2 → $3 → $4. There is no intended maximum Takeover Price.

The authoritative price is determined by The Big Dog’s server and database, not by information stored in the user’s browser. A takeover only completes once payment has been successfully confirmed. Reaching checkout, initiating payment or receiving a client-side payment message does not by itself transfer the title.

4. How long you remain The Big Dog

There is no guaranteed ownership period. A purchaser remains the current Big Dog only until another eligible user successfully completes the next takeover, which may happen very shortly after the previous purchase.

There is no cooling-off period between title holders preventing another eligible user from attempting a takeover. A previous Big Dog may attempt to purchase the title again at the then-current Takeover Price.

5. Future payments do not go to previous Big Dogs

All payments for taking the title are payments for the service supplied by the operator of The Big Dog. A previous Big Dog does not receive the next purchaser’s payment.

Previous title holders have no right to:

  • the next takeover payment;
  • a percentage of future payments;
  • commission;
  • royalties;
  • investment returns;
  • appreciation in the Takeover Price.

The increasing Takeover Price must not be interpreted as an account balance, investment value or amount owed to a previous title holder.

6. Public information

By becoming The Big Dog, the purchaser understands that certain information associated with the title is intentionally public. Depending on the features enabled, this may include:

  • username;
  • display name;
  • profile photograph;
  • age;
  • nationality;
  • national flag;
  • selected social-media handle;
  • selected social-media platform;
  • link to the selected public social-media profile;
  • amount paid;
  • takeover date and time;
  • reign duration;
  • historical title ownership.

The purchaser’s email address, full date of birth, payment-card details and other designated private account information are not displayed publicly. The amount paid to take the title is public. The Big Dog does not publicly display cumulative company revenue.

7. Social-media profiles

Users may provide social-media handles for use with their public Big Dog profile. The current display priority is Instagram → X → TikTok → YouTube → Big Dog username.

Users must only submit social accounts they are authorised to associate with their Big Dog profile, and must not impersonate another person, company, celebrity or organisation. The Big Dog may remove, disable or refuse social links reasonably believed to be fraudulent, misleading, impersonating another person, unlawful or otherwise inappropriate.

The Big Dog is not affiliated with or endorsed by Instagram, Meta, X, TikTok, YouTube, Google or other social platforms merely because links to those platforms appear on the service.

8. Profile photographs and user content

Users may upload or capture a photograph for their Big Dog profile, and must have the necessary rights and permissions to use anything they upload. Users must not upload content that:

  • infringes another person’s rights;
  • impersonates another person;
  • is unlawful;
  • is threatening or abusive;
  • contains illegal sexual content;
  • promotes terrorism or illegal activity;
  • contains malicious code;
  • is otherwise reasonably considered unsuitable for the service.

By submitting profile content, the user grants The Big Dog a non-exclusive licence to host, reproduce, resize, crop and display that content only as reasonably necessary to operate, promote and provide The Big Dog service. Users retain ownership of their original content. The Big Dog may remove or restrict content where reasonably necessary for legal, security, moderation or operational reasons.

9. Age requirement

Purchasing The Big Dog title is restricted to persons aged 18 or over. Users must provide accurate age and date-of-birth information. The Big Dog may request additional verification where reasonably required.

10. Payment

The applicable Takeover Price is displayed before payment, and payment must be successfully completed through an available payment method before ownership changes. Payment processing may be provided by third-party payment processors such as Stripe. The Big Dog does not itself store full payment-card details where these are processed by the payment provider.

11. Cancellation, withdrawal and refunds

Because The Big Dog title is intended to become active immediately after successful payment, users may be asked during checkout to expressly request immediate performance of the service and acknowledge the consequences this may have for any statutory cancellation or withdrawal rights available to them.

Where applicable law gives a consumer rights that cannot legally be excluded or restricted, those rights remain unaffected. Refund requests will be assessed in accordance with applicable law and these Terms.

A purchaser is not automatically entitled to a refund merely because:

  • another user subsequently takes the title;
  • their reign was shorter than expected;
  • they change their mind after becoming Big Dog;
  • the Takeover Price subsequently increases;
  • they expected to receive money from a later purchaser.

Nothing in these Terms removes statutory consumer rights that cannot lawfully be excluded.

12. Availability of the service

The Big Dog is intended to operate on an ongoing basis, but continuous or indefinite availability is not guaranteed. The service may occasionally be unavailable, suspended, maintained, modified, upgraded or restricted.

The operator may suspend, materially modify or discontinue some or all of the service where reasonably necessary for technical, security, legal, regulatory, operational or commercial reasons. Where reasonably practicable, appropriate notice will be provided before material permanent discontinuation. Nothing in this clause removes consumer rights or remedies that cannot lawfully be excluded.

13. No guarantee of social or commercial benefit

Becoming The Big Dog does not guarantee:

  • social-media followers;
  • website traffic;
  • publicity;
  • press coverage;
  • commercial opportunities;
  • sponsorship;
  • endorsements;
  • financial gain.

Any exposure or publicity resulting from holding the title is incidental and not guaranteed.

14. Acceptable use

Users must not:

  • manipulate the takeover system;
  • interfere with payments;
  • attempt fraudulent transactions;
  • exploit technical vulnerabilities;
  • create misleading identities;
  • impersonate other people;
  • harass other users;
  • upload illegal material;
  • use automated systems to abuse the service;
  • attempt unauthorised access to accounts or infrastructure.

Accounts may be restricted or suspended where reasonably necessary to protect users, the service or comply with law.

15. Intellectual property

The Big Dog name, branding, website design, logos, graphics and original website content belong to the operator or its licensors unless otherwise stated. Purchasing the title does not transfer ownership of The Big Dog brand or other intellectual property. Users may share the site’s official Big Dog share cards and similar materials for personal and social promotional purposes where provided by the service.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful. Subject to applicable law, The Big Dog is not responsible for losses that were not reasonably foreseeable when the contract was formed, or losses resulting from circumstances outside its reasonable control.

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such exclusion would be unlawful, or statutory consumer rights that cannot lawfully be excluded.

17. Changes to these Terms

The Terms may be updated where reasonably necessary, including because of changes to the service, law, regulation, payment providers or security requirements. The version applicable to a purchase is recorded at the time of purchase. Material changes will be communicated appropriately where required.

18. Governing law and international users

The Big Dog is operated from the United Kingdom. These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to a consumer in their country of residence.

Privacy Notice

The Big Dog collects the information required to operate accounts, process purchases and display public Big Dog profiles and history.

Information we may collect

  • email address;
  • account identifiers;
  • username;
  • display name;
  • date of birth;
  • derived age;
  • nationality and country;
  • profile photograph;
  • social-media handles and profile URLs;
  • title ownership history;
  • purchase and payment transaction records;
  • technical and security information such as IP, device or session information where collected;
  • communications with support.

Public information

The following may intentionally be public:

  • username and display name;
  • profile photo where associated with public Big Dog ownership;
  • age — but not your full date of birth;
  • nationality and flag;
  • selected social identity;
  • title history;
  • amount paid;
  • takeover and reign information.

Private information

Your email address and full date of birth are not intended to be publicly displayed. Full card and payment credentials are handled by the payment processor rather than being stored by The Big Dog where applicable.

Why data is used

  • creating and managing accounts;
  • verifying eligibility;
  • processing purchases;
  • operating the takeover system;
  • displaying Big Dog profiles and history;
  • fraud and security prevention;
  • customer support;
  • complying with legal obligations;
  • improving the service where lawful.

Legal bases

Depending on the processing, the legal bases may include performance of a contract, legal obligations, legitimate interests, and consent where required.

Data sharing

Information may be shared with service providers necessary to operate the service, such as hosting and database providers, payment processors, email providers, security and fraud providers, analytics providers where enabled and lawful, professional advisers, and regulators or law enforcement where legally required. Specific processors will be identified here once they are actually used in production.

International transfers

Some providers may process information outside your home country. Appropriate safeguards will be used where legally required.

Retention

Data is kept only as long as reasonably necessary for account operation, transaction records, legal, tax and accounting obligations, fraud and security, and dispute handling. Historical public Big Dog ownership records may be retained as part of the service’s Hall of Fame and history features, subject to applicable legal rights.

Your rights

  • access;
  • correction;
  • deletion where applicable;
  • restriction;
  • objection;
  • portability where applicable;
  • withdrawal of consent where processing relies on consent;
  • complaint to the relevant supervisory authority.

Some records must legally be retained, so deletion rights are not absolute. UK users may complain to the Information Commissioner’s Office (ICO).

Security

Reasonable technical and organisational measures are used to protect information, although no internet service can guarantee absolute security.

Children

Purchases are restricted to users aged 18 or over.

Cookies & Similar Technologies

The Big Dog may use cookies, browser local storage and similar technologies. At present the service only uses strictly necessary storage.

Strictly necessary

These are required for the service to function and are currently the only technologies in use. They include:

  • authentication and session storage that keeps you signed in;
  • security and fraud prevention;
  • checkout and takeover state;
  • preferences you have explicitly requested.

Analytics

Analytics technologies are not currently used on this service. If analytics are enabled in future, this notice will explain their purpose and any consent requirement before they are activated.

Marketing

Advertising and marketing tracking technologies are not currently used. If they are introduced, they may require your consent, which will be requested before they are activated. Consent will never be pre-ticked, and you will be able to accept optional cookies, reject optional cookies or manage your cookie settings.
